The East Riding Health Authority (Change of Name) Order 2000

The Secretary of State for Health, in exercise of the powers conferred on him by sections 8(4) and 126(3) and (4) of the National Health Service Act 1977(1) and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation, commencement and interpretation

1.-(1) This Order may be cited at the East Riding Health Authority (Change of Name) Order 2000 and shall come into force on 1st June 2000.

(2) In this Order-

"the Establishment Order" means the Health Authorities (England) Establishment Order 1996(2);

"the Authority" means the Health Authority established by article 2 of the Establishment Order for the area described in column (2) of the Schedule to that Order as the counties of East Riding of Yorkshire and the city of Kingston-upon-Hull.

Change of name of the Health Authority

2.-(1) The name by which the Authority are known is changed to East Riding and Hull Health Authority.

(2) In column (1) of the Schedule to the Establishment Order, for the entry "East Riding Health Authority" substitute "East Riding and Hull Health Authority".

Transitional provisions

3. The change of name under this Order shall not-

(a)affect any right or obligation of any person; or

(b)be taken as invalidating any instrument (whether made before, on or after the day on which this Order comes into force) which refers to the Authority by its previous name, and all instruments and other documents which refer to the Authority under its previous name shall be construed as referring to it under its new name.

Explanatory Note

(This note is not part of the Order)

This Order changes the name of East Riding Health Authority to East Riding and Hull Health Authority, and makes a consequential amendment to the Health Authorities (England) Establishment Order 1996 and transitional provisions.

1977 c. 49; section 8 was substituted by the Health Authorities Act 1995 (c. 17) ("the 1995 Act"), section 1(1) and amended by the Health Act 1999 (c. 8) ("the 1999 Act"), Schedule 4, paragraph 5; section 126(3) and (4) was amended by the National Health Service and Community Care Act 1990 (c. 19), section 65(2), by the 1995 Act, Schedule 1, paragraph 57, by the National Health Service (Primary Care) Act 1997 (c. 46), Schedule 2, paragraph 27 and by the 1999 Act, Schedule 4, paragraph 37. The functions of the Secretary of State under these provisions are, so far as exercisable in relation to Wales, transferred to the National Assembly for Wales by article 2(a) of, and the entry for the National Health Service Act 1977 in Schedule 1 to, the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672, as amended by section 66(5) of the 1999 Act.
