The Secretary of State in exercise of the powers conferred on him by sections 104, 112(1) and (5) and 115 of and paragraphs 1 and 2 of Schedule 7 to the Scotland Act 1998(1) and considering it necessary to do so in consequence of the provisions of the Food Protection (Emergency Prohibitions) (Oil and Chemical Pollution of Fish) (No. 2) Order 1993 (Revocation) (Scotland) Order 2000(2) makes the following Order:

Title, extent and commencement

1. This Order may be cited as the Food Protection (Emergency Prohibitions) (Oil and Chemical Pollution of Fish) (No. 2) Order 1993 (Revocation) (England, Wales and Northern Ireland) Order 2000; it extends to England, Wales and Northern Ireland only and comes into force on 17th May 2000.

Revocation

2. Insofar as it extends to England, Wales and Northern Ireland, the Food Protection (Emergency Prohibitions) (Oil and Chemical Pollution of Fish) (No. 2) Order 1993(3) is revoked.

Explanatory Note

(This note is not part of the Order)

1. This Order revokes the Food Protection (Emergency Prohibitions) (Oil and Chemical Pollution of Fish) (No. 2) Order 1993 (S.I. 1993/143) insofar as it extends to England, Wales and Northern Ireland.

2. That Order-

(a)designated the area described in the Schedule thereto (a specified area of sea around the Shetland Islands) for the puposes of Part I of the Food and Environment Protection Act 1985 (1985 c. 48) (article 3);

(b)prohibited fishing for or taking fish within that area (article 4);

(c)prohibited the movement of fish out of that area (article 5);

(d)imposed restrictions throughout the United Kingdom in relation to the use of any fish taken from that area (article 6).

3. S.I. 1993/143 had been partially revoked by S.I. 1993/1151, S.I. 1993/3058, S.I. 1994/2555 and S.I. 1995/292 in relation to the United Kingdom as a whole and only remained in force in relation to restictions on fishing for mussels (Mytilis edulis) and Norway lobsters (Nephrops norvegicus). By means of Scottish S.I. 2000/132 the Scottish Ministers have revoked S.I. 1993/143 insofar as it extends to Scotland.

4. No regulatory impact assessment has been prepared in respect of this Order.
