The Secretary of State, in exercise of the powers conferred upon him by section 8(5) of the Disability Rights Commission Act 1999(1), hereby makes the following Regulations:
1.-(1) These Regulations may be cited as the Disability Rights Commission (Expenses) (Scotland) Regulations 2000 and shall come into force on 22nd August 2000.
(2) In these Regulations, "the 1999 Act" means the Disability Rights Commission Act 1999.
(3) These Regulations extend to Scotland only.
2.-(1) This regulation applies in cases where section 8 of the 1999 Act applies.
(2) The expenses incurred by the Commission within the meaning of section 8(2) of the 1999 Act shall be taxed or assessed by the auditor of the sheriff court in which the proceedings in relation to which the Commission provided assistance to an individual under section 7 of the 1999 Act were taken or would have been taken but for any compromise or settlement, as if they were outlays incurred by a solicitor on behalf of the individual.

These Regulations, which relate to Scotland only, provide for determination by the auditor of the sheriff court of the expenses incurred by the Disability Rights Commission in providing assistance under section 7 of the Disability Rights Commission Act 1999 in relation to proceedings which an individual brought or proposed to bring in the sheriff court.
