The Evaluation of Active Substances for Pesticides (Fees) Regulations 2000

The Minister of Agriculture, Fisheries and Food, being designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to the Common Agricultural Policy of the European Community, in exercise of the powers conferred on him by that section, and of all other powers enabling him in that behalf, makes the following Regulations:

Title and commencement

1. These Regulations may be cited as the Evaluation of Active Substances for Pesticides (Fees) Regulations 2000 and shall come into force on 25th August 2000.

Fees payable under Commission Regulation (EC) No. 451/2000

2-(1) The fee payable in relation to each active substance for which the United Kingdom is the designated rapporteur Member State under Annex I to Commission Regulation (EC) No. 451/2000 (laying down the detailed rules for the implementation of the second and third stages of the work programme referred to in Article 8(2) of Council Directive 91/4/4/EEC)(3) shall be in accordance with this regulation.

(2) The fee for the administrative treatment and the evaluation of the notification of each active substance notified in accordance with Article 4 of Commission Regulation (EC) No. 451/2000 shall be £4,500, payable in accordance with Article 12.2 of, and paragraph 3, Part I, Annex IV to, that Regulation.

(3) The fee for the evaluation of a dossier submitted under Article 6 of Commission Regulation (EC) No. 451/2000 shall be £120,000, payable before the evaluation is begun.

(4) If there has already been an evaluation of some of the data relating to an active substance, and the evaluation of that data is not repeated, the fee payable under paragraph (3) above shall be reduced so that the work which is not repeated is not charged for.

Explanatory Note

(This note is not part of the Regulations)

These Regulations set a fee of £4,500 for the administrative treatment and evaluation of notifications of active substances notified to the Pesticides Safety Directorate under Article 4 of Commission Regulation (EC) No. 451/2000, and a fee of £120,000 for the evaluation of a dossier submitted under Article 6 of that Regulation. The notification and evaluation are for active substances for which the United Kingdom is the rapporteur Member State in accordance with Annex I to that Regulation, where a producer wishes to secure the inclusion of that active substance in Annex 1 to Council Directive 91/414/EEC concerning the placing of plant protection products on the market (O.J. L230, 19.8.1991) as last amended by Commission Directive 1999/80/EC (O.J. L210, 10.8.1999, p. 13).

A regulatory impact assessment has been prepared and placed in the library of each House of Parliament. Copies can be obtained from the Pesticide Safety Directorate, Ministry of Agriculture, Fisheries and Food, Mallard House, Kings Pool, 3 Peasholme Green, York YO1 7PX.
