Coming into force in accordance with article 1

The Secretary of State for the Environment, Transport and the Regions makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980(1) and now vested in him(2) and of all other powers enabling him in that behalf:

1. This Instrument may be cited as The County Council of Norfolk (Construction of Cannon Wharf Foot/Cycle Bridge, Norwich) Scheme 2000 Confirmation Instrument 2000 and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The County Council of Norfolk (Construction of Cannon Wharf Foot/Cycle Bridge, Norwich) Scheme 2000 ("the Scheme") is hereby confirmed with modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plan) and copies of the Scheme with its accompanying plan as modified are deposited at the offices of the Department of the Environment, Transport and the Regions, Great Minster House, 76 Marsham Street, London SW1P 4DR, and at the offices of the Director of Law & Administration, Norfolk County Council, County Hall, Martineau Lane, Norwich NR1 2DH.

THE SCHEDULETHE COUNTY COUNCIL OF NORFOLK (CONSTRUCTION OF CANNON WHARF FOOT/CYCLE BRIDGE, NORWICH) SCHEME 2000

The County Council of Norfolk (hereinafter referred to as "the Council") makes this Scheme in exercise of their powers under Section 106(3) of the Highways Act 1980 and of all other powers enabling them in that behalf:-

1. The Council are authorised to construct over the navigable waters of the River Wensum the bridge specified in the Schedule to the Scheme as part of the highway which they are proposing to construct between King Street and Wherry Road in the City of Norwich in the said County.

2. This Scheme may be cited as the County Council of Norfolk (Construction of Cannon Wharf Foot/Cycle Bridge, Norwich) Scheme 2000.

Given under the common seal of the Council on the 8th day of May 2000

THE SCHEDULE TO THE SCHEMEPLANS AND SPECIFICATIONS OF CANNON WHARF FOOT/CYCLE BRIDGE, NORWICH

The location and general design of the bridge are shown on the plan DH521/BD/304-P2 annexed hereto.

Points of Commencement and Termination

From a point on the west bank of the River Wensum 33 metres south-east of the junction of King Street and Rouen Road 200 metres upstream of Carrow Road Lifting Bridge, Norwich.

To a point on the east bank of the River Wensum at Wherry Road 170 metres north-west of the junction of Wherry Road and Koblenz Avenue, Norwich.

Span

Five spans with a main river span of 28.0 metres. There are three approach spans on the east side of the bridge of 11.0, 12.0 and 14.0 metres. The single approach span on the west side of the bridge is 5.0 metres.

Headway

Not less than 4.4 metres above the mean high water spring tide levels (MHWS) of 1.0 metres when the bridge is in its closed position.

Waterway

A minimum clear navigable waterway of 15.0 metres.

Overall Dimensions

The bridge deck has an overall width of 5.67 metres and will carry a 1.5 metre cycleway, with a footway of 1.5 metres width on either side.

MODIFICATIONS TO THE SCHEME

1. Initial title of Scheme-insert bracket before "Construction".

2. Preamble to the Articles-amend to read, ". . . of all other powers enabling them in that behalf".
