Whereas provision is made in relation to Northumbrian Water Limited ("Northumbrian") and Essex and Suffolk Water plc ("Essex and Suffolk") in local statutory provisions;
And whereas the Director General of Water Services has made a variation under section 8 of the Water Industry Act 1991(1) replacing Essex and Suffolk as a water undertaker with effect from 1st April 2000;
And whereas by virtue of that variation Northumbrian will hold an appointment as the water undertaker for the whole of the area for which Northumbrian and Essex and Suffolk each hold appointments as water undertakers;
And whereas with effect from 1st April 2000 Essex and Suffolk will transfer properties, rights and liabilities to Northumbrian by a transfer scheme under Schedule 2 to the Water Industry Act 1991;
And whereas it appears to the Secretary of State appropriate for the purposes of the above-mentioned variation and transfer scheme that provision be made corresponding to provisions originally made by Schedule 26 to the Water Act 1989(2);
Now therefore the Secretary of State, in exercise of the powers conferred upon him by paragraph 7 of Schedule 2 to the Water Industry Act 1991, hereby makes the following Order:
1.-(1) This Order may be cited as the Northumbrian Water and Essex and Suffolk Water (Amendment of Local Enactments Etc.) Order 2000 and shall come into force on 1st April 2000.
(2) In this Order-
"Northumbrian" means Northumbrian Water Limited; and
"Essex and Suffolk" means Essex and Suffolk Water plc.
2.-(1) Any reference to Essex and Suffolk, or to the undertaking of Essex and Suffolk, in any local statutory provision and in any charges scheme made by Essex and Suffolk under section 76 of the Water Act 1989 or section 143 of the Water Industry Act 1991 shall have effect, subject to paragraph (2), as a reference to Northumbrian or, as the case may be, to the undertaking of Northumbrian.
(2) Paragraph (1) only applies to any local statutory provision or charges scheme in relation to the area, things or persons in relation to which or whom that provision or scheme has effect before 1st April 2000.
