The Secretary of State for Environment, Food and Rural Affairs and the National Assembly for Wales, being designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, acting jointly (the National Assembly for Wales acting in relation to Wales only), in exercise of the powers conferred on them by that section 2(2), and of all other powers enabling them in that behalf, make the following Regulations:
Title, commencement and extent
1.
These Regulations may be cited as the Plant Protection Products (Amendment) (No. 2) Regulations 2001, extend to England and Wales, and come into force on 1st August 2001.
Amendment of the Plant Protection Products Regulations 1995
2.
In so far as they extend to England and Wales, the Plant Protection Products Regulations 1995[3] shall be amended by substituting for the definition of "the Directive" in regulation 2(1), the following definition -
"
"the Directive" means Council Directive 91/414/EEC concerning the placing of plant protection products on the market[4], as amended by -
(a) Commission Directive 93/71/EEC[5];
(b) Commission Directive 94/37/EC[6];
(c) Commission Directive 94/79/EC[7];
(d) Commission Directive 95/35/EC[8];
(e) Commission Directive 95/36/EC[9];
(f) Commission Directive 96/12/EC[10];
(g) Commission Directive 96/46/EC[11];
(h) Commission Directive 96/68/EC[12];
(i) Council Directive 97/57/EC[13];
(j) Commission Directive 97/73/EC[14];
(k) Commission Directive 98/47/EC[15];
(l) Commission Directive 1999/1/EC[16];
(m) Commission Directive 1999/73/EC[17];
(n) Commission Directive 1999/80/EC[18];
(o) Commission Directive 2000/10/EC[19];
(p) Commission Directive 2000/49/EC[20];
(q) Commission Directive 2000/50/EC[21];
(r) Commission Directive 2000/66/EC[22];
(s) Commission Directive 2000/67/EC[23];
(t) Commission Directive 2000/68/EC[24];
(u) Commission Directive 2001/28/EC[25];".
Revocation

The Plant Protection Products (Amendment) Regulations 2001[26] are revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which extend to England and Wales, further amend the Plant Protection Products Regulations 1995 (S.I. 1995/887) which implement in Great Britain Council Directive 91/414/EEC concerning the placing of plant protection products on the market (OJ No. L230, 19.8.91, p. 1 as read with OJ No. L170, 25.6.92, p. 40).
The Regulations amend the definition of "the Directive" in S.I. 1995/887 so as to implement -
Commission Directive 2000/66/EC (OJ No. L276, 28.10.2000, p. 35)
Commission Directive 2000/67/EC (OJ No. L276, 28.10.2000, p. 38)
Commission Directive 2000/68/EC (OJ No. L276, 28.10.2000, p. 41)
Commission Directive 2001/28/EC (OJ No. L113, 24.4.2001, p. 5)
which add triasulfuron, esfenvalerate, bentazone and fenhexamid respectively to Annex I to the Directive.
The Regulations revoke the Plant Protection Products Regulations 2001 (S.I. 2001/1112) which are either spent or consolidated in these Regulations.
