In exercise of the powers conferred on the Secretary of State by sections 6(4), (5) and 7(1), 138(7) and (8) of the School Standards and Framework Act 1998[1], the Secretary of State for Education and Skills hereby makes the following Regulations -
Citation, commencement, application and interpretation
1.
- (1) These Regulations may be cited as the Education Development Plans (England) (Amendment) Regulations 2002 and shall come into force on 1st April 2002.
(2) These Regulations apply in England.
(3) In these Regulations, "the Principal Regulations" means the Education Development Plans (England) Regulations 2001[2].
Amendment
2.
In regulation 2(1) of the Principal Regulations, in the definition of "children leaving public care" the words "are or" are omitted.

- (1) In relation to the areas set out in paragraph (2) the Principal Regulations are amended as set out in regulations 4 to 7.
(2) The areas to which paragraph (1) applies are the areas of the following local education authorities -
(a) Birmingham City Council;
(b) Blackburn with Darwen Borough Council;
(c) Derbyshire County Council;
(d) Stockton-on-Tees Borough Council; and
(e) Warwickshire County Council.
4.
In regulation 5 of the Principal Regulations for "31st January" there is substituted "30th April".
5.
Regulations 11, 15 and 16 of the Principal Regulations are omitted.
6.
In regulation 13 of the Principal Regulations for "14 to 18" there is substituted "14, 17 and 18".
7.
In regulation 18 of the Principal Regulations, for "description" there is substituted "brief summary" and all the words after the first occurrence of "second plan" are omitted.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations, which are made under sections 6, 7 and 138 of the School Standards and Framework Act 1998, amend the Education Development Plans (England) Regulations 2001 ("the 2001 Regulations").
Regulation 2 corrects a drafting error in the 2001 Regulations.
The remainder of the amendments apply in relation to the areas of five local education authorities in England, set out in regulation 3, namely Birmingham, Blackburn with Darwen, Derbyshire, Stockton-on-Tees and Warwickshire.
These local education authorities are taking part in a pilot project for the rationalisation of education plans within the framework of their Local Public Service Agreements. Within the pilot project it is appropriate that the 2001 Regulations should be amended in relation to the areas of these local education authorities.
Regulation 4 amends regulation 5 of the 2001 Regulations so that the five local education authorities must submit the second education development plan to the Secretary of State by 30th April 2002.
Regulation 5 omits the following regulations of the 2001 Regulations in their application to the five local education authorities: regulations 11 (Information used by a local education authority in the setting of targets), 15 (Description of the local education authority's proposed activities) and 16 (Resources). Regulation 6 makes an amendment consequential on those made by regulation 5.
Regulation 7 amends regulation 18 of the 2001 Regulations to reduce the information required of the five local education authorities in respect of the consultation they have undertaken in the preparation of the second education development plan.
