Education (London Residuary Body) (Property Transfer) (Amendment) Order 2002

In exercise of the powers conferred on the Secretary of State by sections 187(5) (6) and (7), 231(2) and 232(5) of the Education Reform Act 1988[1] the Secretary of State for Education and Skills hereby makes the following Order:

     1. This Order may be cited as the Education (London Residuary Body) (Property Transfer) (Amendment) Order 2002 and shall come into force on 1st September 2002.

    
2. The Education (London Residuary Body) (Property Transfer) Order 1992[2] is amended by substituting for Article 4(6)[3] the following paragraph:

EXPLANATORY NOTE

(This note is not part of the Order)


This Order amends the Education (London Residuary Body) (Property Transfer) Order 1992.

The 1992 Order (as amended by S.I. 1994/3105, Article 3) transferred land described as the former Henry Thornton Secondary School, 45 Clapham Common South Side, London SW4 to the London Borough of Lambeth. Transfer was made subject to the condition that by 1st April 1995 the land be brought into use wholly or mainly for the purposes of an institution for the full-time education of persons over compulsory school age who have not attained the age of 19 years. The Order further provided that if the land were not so brought into use, it should be disposed of and the proceeds of sale (after deductions) divided between the Councils of the Inner London Boroughs and the Common Council of the City of London. In 1998 part of the site was transferred to Lambeth College.

This Order amends the condition in relation to that part of the land retained by the London Borough of Lambeth by extending the date by which it should be fulfilled to 1st September 2006 and by extending the use to which the land may be put to an institution for full-time education. The restriction to the education of persons over compulsory school age of persons who have not attained the age of 19 years is removed.

The plans of the registered titles can be inspected at the Telford District Land Registry, Parkside Court, Hall Park Way, Telford TF3 4LR during normal office hours.
