The Transfer of Functions (Civil Defence) Order 2002

  Made 22nd October 2002 
  Laid before Parliament 4th November 2002 
  Coming into force 25th November 2002

The Queen's Most Excellent Majesty in Council

Her Majesty, in pursuance of section 1 of the Ministers of the Crown Act 1975[1], is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

Citation and commencement
     1.  - (1) This Order may be cited as the Transfer of Functions (Civil Defence) Order 2002.

    (2) This Order shall come into force on 25th November 2002.

Civil Defence Act 1948
    
2. A function of the Secretary of State which arises by virtue of the proviso to section 9(2) of the Civil Defence Act 1948[2] (ministerial responsibility) shall be exercisable concurrently with the Chancellor of the Duchy of Lancaster.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order enables the Chancellor of the Duchy of Lancaster to exercise any function of the Secretary of State arising under the proviso to section 9(2) of the Civil Defence Act 1948. The effect of the Order is that the Chancellor of the Duchy of Lancaster will be able, in the same way as a Secretary of State, to exercise any function under the Act which has not been specifically designated by Order in Council as the function of another Minister.
