The State Pension Credit Act 2002 (Commencement No. 4) Order 2003

  Made 1st April 2003 

The Secretary of State for Work and Pensions, in exercise of the powers conferred by section 22(3) of the State Pension Credit Act 2002[1], and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and interpretation
     1.  - (1) This Order may be cited as the State Pension Credit Act 2002 (Commencement No.4) Order 2003.

    (2) In this Order, references to sections and Schedules are, unless the context otherwise requires, to sections of, and Schedules to, the State Pension Credit Act 2002.

Article 2(b)


REPEALS SPECIFIED IN SCHEDULE 3 WHICH ARE COMMENCED BY THIS ORDER


Act Provision
Social Security Act 1998[2]. In section 2(2), the word "or" immediately preceding paragraph (h).

In section 11(3), in the definition of "current legislation", the word "and" in the second place where it occurs.

In section 28(3), the word "or" immediately preceding paragraph (e).




EXPLANATORY NOTE

(This note is not part of the Order)


This Order appoints 7th April 2003 as the day for the coming into force of section 11 of the State Pension Credit Act 2002 (in so far as it is not already in force) in relation to paragraphs 1 to 7, 10 and 12 of Schedule 1 to that Act (amendments to the Social Security Administration Act 1992 (c. 5) and to the Social Security Act 1998 (c. 14) ("the 1998 Act") which make provision for claims for, and decisions relating to, state pension credit). It also appoints that day for the coming into force of section 21 of, and Schedule 3 to, that Act in so far as it relates to certain repeals which are consequential on the coming into force of the amendments to the 1998 Act.

This Order does not impose any costs on business.



NOTE AS TO EARLIER COMMENCEMENT ORDERS

(This note is not part of the Order)


The following provisions of the State Pension Credit Act 2002 have been brought into force by the State Pension Credit Act 2002 (Commencement No.1) Order 2002 (S.I.2002/1691 (C.51)), by the State Pension Credit Act 2002 (Commencement No.2) Order 2002 (S.I.2002/2248 (C.72)) and by the State Pension Credit Act 2002 (Commencement No.3) Order 2003 (S.I.2003/83 (C.4)). Only section 18 has been brought fully into force; the other provisions have been brought into force partially for the purpose only of exercising any power to make regulations or orders.
