The Crown Court (Forfeiture of Political Donations) Rules 2003

  Made 22nd June 2003 
  Laid before Parliament 27th June 2003 
  Coming into force 24th July 2003 

We, the Crown Court Rule Committee, in exercise of the powers conferred upon us by sections 84(1) and 86 of the Supreme Court Act 1981[1] and section 60(1) of the Political Parties, Elections and Referendums Act 2000[2] make the following Rules:

Citation and commencement
     1. These rules may be cited as the Crown Court (Forfeiture of Political Donations) Rules 2003 and shall come into force on 24th July 2003.

Application of provisions of the Crown Court Rules 1982 with modifications
    
2.  - (1) The Crown Court Rules 1982[3] shall have effect as appropriate in relation to appeals under section 59 of the Political Parties, Elections and Referendums Act 2000 with the following modifications.

    (2) For Rule 7(3) substitute - 

    (3) Omit Rules 7(5) to 7(7).

EXPLANATORY NOTE

(This note is not part of the Rules)


These Rules apply the Crown Court Rules 1982 as appropriate with modifications to appeals to the Crown Court against orders for forfeiture under section 58(2) of the Political Parties, Elections and Referendums Act 2000 ("the Act") (and against orders for forfeiture under section 58(2) of the Act as applied by paragraph 8 of Schedule 7, paragraph 7 of Schedule 11, paragraph 7 of Schedule 15 to the Act and paragraph 7 of Schedule 2A to the Representation of the People Act 1983 (Schedule 2A was inserted by Schedule 16 to the Act)) and orders for forfeiture under section 65(6) of the Act and paragraph 12(4) of Schedule 7 to the Act. Modification of the 1982 rules is required as section 59(2) of the Act makes specific provision as the time limit for an appeal to the Crown Court against such orders.
