Being of the opinion that the Teacher Training Agency may, having regard to their general objectives, appropriately discharge the additional function hereby conferred, and having carried out such consultation as appears to him to be appropriate pursuant to section 16(3) of the Education Act 1994[1], the Secretary of State for Education and Skills, in exercise of the powers conferred by sections 16(1) and 23(2) of that Act, hereby makes the following Order:

This Order may be cited as the Teacher Training Agency (Additional Functions) (No. 2) (Amendment) Order 2003 and shall come into force on 1st September 2003.
2.
The Teacher Training Agency (Additional Functions) (No. 2) (Amendment) Order 2002[2] is hereby revoked.
3.
The Teacher Training Agency (Additional Functions) (No. 2) Order 2000[3] is amended as follows.

In the definition of "graduate teacher" in article 2(1), substitute the following sub-paragraph for sub-paragraph (b) -
"
(b) participates in an employment-based teacher training scheme referred to in paragraph 10 of Schedule 2 to the Education (School Teachers' Qualifications) (England) Regulations 2003[4] or undertakes teacher training as if for the purposes of that paragraph by virtue of paragraph 5 or 6 of Schedule 1 to those Regulations; and";
and omit sub-paragraph (c).

In article 4 -
(a) omit "and" at the end of paragraph (c); and
(b) at the end of paragraph (d) insert "; and" and the following paragraph -
"
(e) an independent school in respect of which proposals under section 28 of the School Standards and Framework Act 1998[5] have been published, have been approved under paragraph 3 of Schedule 6 to that Act and are required to be implemented by virtue of paragraph 5(1) of that Schedule.".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Teacher Training Agency (Additional Functions) (No. 2) Order 2000 ("the 2000 Order"). It amends the definition of "graduate teacher" in that Order to reflect changes made by the Education (School Teachers' Qualifications) (England) Regulations 2003 (S.I. 2003/1662). In addition this Order inserts a new paragraph (e) in article 4 of the 2000 Order. This will enable graduate teachers at independent schools which fall within the terms of that paragraph to receive grants payable under the 2000 Order, if they are undertaking employment-based training with a view to obtaining qualified teacher status.
