Being of the opinion that the Teacher Training Agency[1] may, having regard to their general objectives, appropriately discharge the additional functions hereby conferred and having carried out such consultation as appears to him to be appropriate pursuant to section 16(3) of the Education Act 1994, the Secretary of State in the exercise of the powers conferred by sections 16(1) and 23(2) of that Act, hereby makes the following Order:
Citation, commencement and application
1.
- (1) This Order may be cited as the Teacher Training Agency (Additional Functions) (No. 3) (England) Order 2003 and shall come into force on 3rd November 2003.
(2) This Order shall only apply in relation to England.
Interpretation
2.
In this Order -
"the Agency" means the Teacher Training Agency;
"higher level teaching assistant" means a person who assists or supports the work of a teacher in a school and who has met any standards for higher level teaching assistants published by the Secretary of State; and
"training for higher level teaching assistants" includes any training or education with the object of fitting persons to be higher level teaching assistants or better higher level teaching assistants and any assessment of persons against any standards for higher level teaching assistants published by the Secretary of State.
Conferring of additional functions

The additional functions contained in the Schedule are hereby conferred on the Agency.

SCHEDULEArticle 3
1.
- (1) The Agency may give financial assistance to any person for or in connection with the purpose of providing training for higher level teaching assistants pursuant to any arrangements made by the Secretary of State under sections 14 to 17 of the Education Act 2002[2].
(2) The Agency may specify terms and conditions on which such financial assistance may be given.

The Agency may provide services or carry out other activities for or in connection with the purposes of -
(a) providing training for higher level teaching assistants; or
(b) providing information and advice on working as a higher level teaching assistant as a career.
3.
The Agency -
(a) shall provide the Secretary of State (in such manner as he may from time to time determine) with such information or advice relating to training for higher level teaching assistants as he may from time to time require, and
(b) may provide the Secretary of State with such information or advice relating to training for higher level teaching assistants as they think fit.
4.
- (1) The Agency may approve, or withdraw approval from, a person as a provider of training for higher level teaching assistants in accordance with such criteria as may be specified from time to time by the Secretary of State.
(2) The Agency may inspect, or make arrangements for the inspection of -
(a) any training for higher level teaching assistants which is provided by a person approved under sub-paragraph (1); and
(b) a person approved under sub-paragraph (1).
5.
The Agency may approve, or withdraw approval from, training provided by a person approved under paragraph 4 in accordance with such criteria as may be specified from time to time by the Secretary of State.
6.
The Agency may award, or make arrangements for the awarding of, on behalf of the Secretary of State higher level teaching assistant status to a person who has successfully met any standards for higher level teaching assistants published by the Secretary of State.
EXPLANATORY NOTE
(This note is not part of the Order)
This Order confers on the Teacher Training Agency the additional functions of giving financial assistance to any persons for the purpose of providing training for higher level teaching assistants, providing related services and activities, providing information and advice to the Secretary of State, approving training and providers of training and awarding higher level teaching assistant status to persons who have met the appropriate standards.
