The Sustainable Energy (CHP Provisions) Order 2003

  Made 19th November 2003 
  Laid before Parliament 20th November 2003 
  Coming into force 15th December 2003 

The Secretary of State, in exercise of the powers conferred upon her by section 5(5)(a) and (b) of the Sustainable Energy Act 2003[1] hereby makes the following Order:

Citation, commencement and interpretation
     1.  - (1) This Order may be cited as the Sustainable Energy (CHP Provisions) Order 2003 and shall come into force on 15th December 2003.

    (2) In this Order, "the Act" means the Sustainable Energy Act 2003(a).

Definition of the government for the purposes of section 5
    
2. For the purposes of section 5 of the Act, the government departments and other bodies which together constitute "the government" are set out in the Schedule.

Exclusions from the estimation of the amount of electricity that the government will use
    
3. For the purposes of any CHP target specified by the Secretary of State in a statement made pursuant to section 5(1) of the Act, there shall be excluded in the period specified in relation to that target from the estimation of the amount of electricity that the government will use, electricity used -

EXPLANATORY NOTE

(This note is not part of the Order)


This Order defines "the government" for the purposes of setting a CHP target pursuant to section 5(1) of the Sustainable Energy Act 2003 for England and Wales. It also specifies the circumstances, and those parts of the government, to be excluded from the estimation of the amount of electricity that the government will use in the period specified in the target.

Article 2 defines "the government" as comprising those government departments and other bodies set out in the Schedule.

Article 3 specifies any premises being outside England and Wales as the circumstances in which, and the parts of the government whose, electricity use will be excluded from the estimation.
