ROAD TRAFFIC

The Traffic Signs (Amendment) General Directions 2004

  Made 6th May 2004 
  Coming into force 27th May 2004 

The Secretary of State for Transport, in exercise of the powers conferred by section 65 of the Road Traffic Regulation Act 1984[1] hereby gives the following Directions:

Citation and commencement
     1. These Directions may be cited as the Traffic Signs (Amendment) General Directions 2004 and shall come into force on 27th May 2004.

Amendment of the Traffic Signs General Directions 2002
    
2.  - (1) Direction 42 of the Traffic Signs General Directions 2002[2] is amended as follows.

    (2) At the end of paragraph (5) insert "and, if coloured yellow, may be - 

    (3) For paragraphs (6) and (7) substitute -

EXPLANATORY NOTE

(This note is not part of the Directions)


These Directions amend direction 42 of the Traffic Signs General Directions 2002 (mounting and backing of signs). The amendments provide that, if the front of a backing board is coloured yellow, it may be reflectorised, fluorescent or both reflectorised and fluorescent. A yellow backing board for a combination of a sign shown in diagram 2402.1 (name of a town or village commencing immediately ahead) with a sign shown in diagram 670 (maximum speed limit in miles per hour) on the same backing board may be of any shape, including rectangular.

These Directions were notified in draft to the European Commission in accordance with Directive 98/34/EC as amended by Directive 98/48/EC. Copies of the Directive can be obtained from the Stationery Office.

Section 65 was amended by the Roads (Scotland) Act 1984 (c. 54), Schedule 9, paragraph 93, the Local Government and Housing Act 1989 (c. 42), section 153, the New Roads and Street Works Act 1991, Schedule 8, paragraph 48 and the Road Traffic Act 1991 (c. 40), Schedule 4, paragraph 29. Amendments were made relating to the exercise of powers under section 65 by S.I. 1999/672 and 1750. By virtue of S.I. 1993/3143 the functions under section 65 which were exercisable by "the Ministers acting jointly" were transferred to the Secretary of State.back
