CIVIL AVIATION

The Single European Sky (National Supervisory Authority) Regulations 2004

  Made 22nd July 2004 
  Laid before Parliament 9th August 2004 
  Coming into force 31st August 2004 

The Secretary of State for Transport, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to air transport, in exercise of the powers conferred by that section, hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Single European Sky (National Supervisory Authority) Regulations 2004 and shall come into force on 31st August 2004.

National Supervisory Authority
    
2. The Civil Aviation Authority shall be the national supervisory authority for the purpose of performing the tasks assigned to such an authority under the measures listed in the Schedule to these Regulations.

    
3. Section 4 of the Civil Aviation Act 1982[3] (general objectives of the CAA) shall not apply to the tasks to which regulation 2 applies; and instead, in undertaking such tasks it shall be the duty of the Civil Aviation Authority to exercise their powers in a manner that ensures compliance with article 4.2 of Regulation (EC) No 549/2004 of the European Parliament and of the Council laying down the framework for the creation of the single European Sky (the framework Regulation)[4].

Regulation (EC) No 549/2004 of the European Parliament and of the Council of 10 March 2004 laying down the framework for the creation of the single European sky (the framework Regulation)

Regulation (EC) No 550/2004 of the European Parliament and of the Council of 10 March 2004 on the provision of air navigation services in the single European sky (the service provision Regulation)[

Regulation (EC) No 551/2004 of the European Parliament and of the Council of 10 March 2004 on the organisation and use of the airspace in the single European sky (the airspace Regulation)[6]

Regulation (EC) No 552/2004 of the European Parliament and of the Council of 10 March 2004 on the interoperability of the European Air Traffic Management network (the interoperability Regulation)[7]



EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations specify the Civil Aviation Authority as the UK's national supervisory authority for the purpose of performing the tasks assigned to such an authority under the measures listed in the Schedule to these Regulations relating to the provision of air navigation services in the single European sky.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
