IMMIGRATION AND ASYLUM

The Asylum Support (Amendment) (No.2) Regulations 2005

  Made 9th March 2005 
  Laid before Parliament 16th March 2005 
  Coming into force 11th April 2005 

The Secretary of State, in exercise of the powers conferred upon him by section 166(3) of, and paragraphs 1 and 3(a) of Schedule 8 to, the Immigration and Asylum Act 1999 [1] hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Asylum Support (Amendment) (No.2) Regulations 2005 and shall come into force on 11th April 2005.

Kind and levels of support for essential living needs
    
2. For the table at regulation 10(2) of the Asylum Support Regulations 2000 [2] substitute:


"TABLE

Qualifying couple £61.71
Lone parent aged 18 or over £39.34
Single person aged 25 or over £39.34
Single person aged at least 18 but under 25 £31.15
Person aged at least 16 but under 18 (except a member of a qualifying couple) £33.85
Person aged under 16 £43.88".


Revocation of the Asylum Support (Amendment) Regulations 2004
     3. The Asylum Support (Amendment) Regulations 2004 [3] are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which come into force on 11th April 2005, replace the table in regulation 10(2) of the Asylum Support Regulations 2000, as amended. They increase the total value, for any week, of asylum support in the form of a cash payment, which may generally be expected to be provided under section 95 of the Immigration and Asylum Act 1999 in respect of the essential living needs of a person or qualifying couple.

They increase the total value provided (for a qualifying couple) to £61.71 from £61.11; (for a lone parent aged 18 or over) to £39.34 from £38.96; (for a single person aged 25 or over) to £39.34 from £38.96; (for a single person aged at least 18 but under 25) to £31.15 from £30.84; (for a person aged at least 16 but under 18 (except a member of a qualifying couple)) to £33.85 from £33.50 and (for a person aged under 16) to £43.88 from £42.27.

These Regulations also revoke the Asylum Support (Amendment) Regulations 2004.
