The Secretary of State for Health, in exercise of the powers conferred upon him by section 6(5) of the Carers (Equal Opportunities) Act 2004[1], and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation and commencement
1.
This Order may be cited as the Carers (Equal Opportunities) Act 2004 (Isles of Scilly) Order 2005 and shall come into force on 28th April 2005.
Application of section 3 of the Carers (Equal Opportunities) Act 2004 to the Isles of Scilly
2.
Section 3 of the Carers (Equal Opportunities) Act 2004 (co-operation between authorities) shall, in its application to the Isles of Scilly, have effect with the modifications that -
(a) except for the reference in subsection (5)(a), any reference to a local authority shall, in relation to the Isles of Scilly, be construed as a reference to the Council of the Isles of Scilly;
(b) subsection (5)(a) shall, in relation to a request made by the Council of the Isles of Scilly, have effect as if the word "other" is omitted; and
(c) in relation to a request made by a local authority, the list of authorities in subsection (5) shall be construed as including the Council of the Isles of Scilly.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order provides that in its application to the Isles of Scilly section 3 of the Carers (Equal Opportunities) Act 2004 ("the Act") shall have effect with the modification that any reference to a local authority shall, in relation to the Isles of Scilly, be construed as a reference to the Council of the Isles of Scilly. This does not apply to the reference in subsection (5)(a) which, in relation to a request made by the Council, shall have effect as if the word "other" is omitted, but the Order adds the Council of the Isles of Scilly to the list of authorities mentioned in section 3(5) of the Act in relation to a request made by a local authority.
A regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
