The Commission for Social Care Inspection (Fees and Frequency of Inspections) (Amendment) Regulations 2006

  Made 28th February 2006

  Coming into force 1st April 2006 

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 12(2), 15(3), 16(3), 31(7), 45(4) and 118(5) and (6) of the Care Standards Act 2000[1] and section 87D(2) of the Children Act 1989[2].

Citation, commencement, application and interpretation
     1. —(1) These Regulations may be cited as the Commission for Social Care Inspection (Fees and Frequency of Inspections) (Amendment) Regulations 2006 and shall come into force on 1st April 2006.

    (2) These Regulations apply in relation to England only.

    (3) In these Regulations, "the principal Regulations" means the Commission for Social Care Inspection (Fees and Frequency of Inspections) Regulations 2004[
3].

Amendment of regulation 3 of the principal Regulations
     2. Regulation 3 of the principal Regulations (registration fees) is amended as follows—

4. —(1) Regulation 5 of the principal Regulations (annual fees) is amended in accordance with the following paragraphs of this regulation.

4], for "50% of the flat rate specified in column (2)" substitute "£994".

Amendment of regulation 6 of the principal Regulations
     5. For regulation 6 (frequency of inspections) of the principal Regulations substitute—

6. The Commission for Social Care Inspection (Fees and Frequency of Inspections) (Amendment) Regulations 2005[5] are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations, which apply in relation to England only, amend the Commission for Social Care Inspection (Fees and Frequency of Inspections) Regulations 2004.

Regulations 2 to 4 increase the amount of the fees that are to be paid to the Commission for Social Care Inspection by establishments and agencies (other than voluntary adoption agencies, adoption support agencies, independent hospitals, independent clinics and independent medical agencies and local authority fostering services) under Part 2 of the Care Standards Act 2000. The increases take effect from 1st April 2006.

Regulation 5 amends the minimum required frequency of inspections by CSCI of certain premises. It changes the minimum frequency for inspection of premises used for the purposes of care homes, domiciliary care agencies, nurses agencies and adult placement schemes from once in every 12 months to once in every three years.

A Regulatory Impact Assessment has been prepared for these Regulations and a copy has been placed in the library of each House of Parliament. Copies of the Regulatory Impact Assessment can be obtained from the Department of Health's website[
