The Common Agricultural Policy Single Payment and Support Schemes (Amendment) (No. 3) Regulations 2006

  Coming into force 1st April 2006 

The Secretary of State for Environment, Food and Rural Affairs makes the following Regulations under the powers conferred by section 2(2) of the European Communities Act 1972[1].

     She has been designated[2] for the purposes of that section in relation to the common agricultural policy of the European Community.

Title, commencement and application
     1. —(1) These Regulations may be cited as the Common Agricultural Policy Single Payment and Support Schemes (Amendment) (No. 3) Regulations 2006.

    (2) These Regulations come into force on 1st April 2006.

2. For regulation 10 (Transfers) of the Common Agricultural Policy Single Payment and Support Schemes Regulations 2005[3] substitute—

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations substitute a new regulation 10 in the Common Agricultural Policy Single Payment and Support Schemes Regulations 2005 (S.I. 2005/219). The effect of the amendment is to reduce from six weeks to three weeks the amount of notice which a transferor of payment entitlements is required to give the relevant competent authority of a transfer of payment entitlements, provided he gives such notice on or before 23rd April 2006. Where a transferor of payment entitlements gives the relevant competent authority notice of a transfer of entitlements after 23rd April 2006, he is still required to give at least six weeks notice of the transfer.

A full regulatory impact assessment has not been produced for these Regulations as they have no impact on the costs of business.
