SECURE TRAINING CENTRES, ENGLAND AND WALES

The Criminal Justice and Public Order Act 1994 (Suspension of Custody Officer Certificate) (Amendment) Regulations 2006

The Secretary of State, in exercise of the powers conferred upon him by paragraph 3 of Schedule 2 to the Criminal Justice and Public Order Act 1994[1] makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Criminal Justice and Public Order Act 1994 (Suspension of Custody Officer Certificate) (Amendment) Regulations 2006 and shall come into force on 2nd May 2006.

Amendment of prescribed circumstances
    
2. In regulation (2)(a)(i) of the Criminal Justice and Public Order Act 1994 (Suspension of Custody Officer Certificate) Regulations 1998[2] after "an allegation" insert the words "of misconduct".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend regulation 2(a)(i) of the Criminal Justice and Public Order Act 1994 (Suspension of Custody Officer Certificate) Regulations 1998. These Regulations amend the circumstances in which the escort monitor or person in charge of a secure training centre may suspend a custody officer's certificate insofar as it authorises the performance of escort functions or custodial duties pending a decision of the Secretary of State under paragraph 4 of Schedule 2 to the Criminal Justice and Public Order Act 1994 (revocation of a custody officer certificate).

The amendment is needed to clarify the type of allegation that must be made before a custody officer's certificate may be withdrawn. The allegation must be one of misconduct. The amendment was recommended by the Joint Committee on Statutory Instruments in its 29th Report in 1998.
