The Secretary of State for Education and Skills makes the following Regulations in exercise of the powers conferred upon the Secretary of State by sections 569(4) and (5) of, and paragraph 3 of Schedule 1 to, the Education Act 1996[1]:
Citation, commencement and application
1.
—(1) These Regulations may be cited as the Education (Pupil Referral Units) (Application of Enactments) (England) (Amendment) Regulations 2006 and shall come into force on 12th May 2006.
(2) These Regulations apply only in relation to England.
2.
—(1) The Education (Pupil Referral Units) (Application of Enactments) (England) Regulations 2005[2] are amended as follows.
(2) After paragraph 14 of Part 2 of Schedule 1 insert—
"
School Staffing (England) Regulations 2003
14A.
Regulation 11(3) to (5) and regulation 11A of the School Staffing (England) Regulations 2003[3] apply in relation to any person appointed by a local education authority to work in a unit as they apply respectively in relation to any person referred to in those regulations.".

EXPLANATORY NOTE
(This note is not part of the Order)
These Regulations amend the Education (Pupil Referral Units) (Application of Enactments) (England) Regulations 2005 by inserting a new paragraph 14A into Schedule 1 to those Regulations.
The new paragraph applies to pupil referral units part of regulation 11, and regulation 11A, of the School Staffing (England) Regulations 2003, which require teachers and support staff in maintained schools, including supply teachers employed by local education authorities, to be subject to an enhanced Criminal Records Bureau check prior to or as soon as practicable after their appointment. Accordingly, teachers and support staff appointed by a local education authority to work in a pupil referral unit, including supply teachers appointed for that purpose, must be subject to such a check.
