The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf.
1.
This Order may be cited as the A74 Trunk Road (Carlisle to Guards Mill Section) (Detrunking) Order 2006 and shall come into force on 21st April 2006.

In this Order—
(i) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instruments which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(ii) "the new trunk road" means the new motorway which the Secretary of State proposes to construct referred to in article 3 of the M6 Motorway (Carlisle to Guards Mill Section) and Connecting Roads Scheme 2006;[3]
(iii) "the trunk road" means the A74 Trunk Road (Carlisle to Guards Mill Section)

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall become a classified road in the case of Sections 1 and 2 and an unclassified road in the case of Section 3 from the date on which the Secretary of State notifies Cumbria County Council that the new trunk road is open for traffic.

SCHEDULE 1
Length of the Trunk Road ceasing to be a Trunk Road
1.
The southbound slip of the A74 Trunk road at Floriston Bridge for a distance of 156 metres, between points "1" and "2" marked on Plan 1.
2.
The northbound slip of the A74 Trunk road at Floriston Bridge for a distance of 167 metres, between points "3" and "4" marked on Plan 1.
3.
A 500-metre length section that includes Todhills Bridge and the south and northbound slip roads from the A74 trunk between points "5" and "6" marked on Plan 2.
