SEEDS, ENGLAND

The Seed Potatoes (Fees) (England) Regulations 2006

  Made 21st April 2006 
  Laid before Parliament 25th April 2006 
  Coming into force 17th May 2006 

The Secretary of State makes the following Regulations in exercise of the powers conferred by section 16(1) and (1A)(e) of the Plant Varieties and Seeds Act 1964[1] and now vested in her[2].

     In accordance with section 16(1) of that Act she has consulted with representatives of such interests as appear to her to be concerned by the following Regulations:

Title, commencement, extent and application
     1. —(1) These Regulations may be cited as the Seed Potatoes (Fees) (England) Regulations 2006 and come into force on 17th May 2006.

    (2) These Regulations extend to England and Wales but apply only to England.

Fees
    
2. —(1) An applicant for—

shall pay to the Secretary of State in respect of any of her functions under the Seed Potatoes (England) Regulations 2006 or to any person authorised by her to carry out such functions on her behalf the fees listed in the Schedule in respect of such functions.

    (2) The fee specified in the Schedule as payable in respect of each function is subject to any minimum fee specified in relation to that function.

Revocations
     3. The Seed Potatoes (Fees)(England) Regulations 2004[4] are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations revoke and replace the Seed Potatoes (Fees) Regulations 2004 (SI 2004/1316), in order to reflect changes made by the Seed Potatoes (England) Regulations 2006 (SI 2006/1161) in the approach taken to official certification of seed potatoes as pre-basic seed potatoes, basic seed potatoes and certified seed potatoes and to the inspection of and provision of seals and labels for seed potatoes belonging to varieties for which an application for entry in a National List has been submitted but not yet determined (which potatoes are now permitted to be marketed for test and trial purposes). The changes primarily reflect changes in terminology and there are no changes to the amount of fees currently payable.

A regulatory impact assessment has not been prepared for this instrument, as it has no impact on the costs of businesses, charities or voluntary bodies.
