The A550 and A5117 Trunk Roads (Improvement between M56 and A548) and Connecting Roads Order 2006

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 41 of the Highways Act 1980[1] and now vested in him[2], and of all other powers enabling him in that behalf:
1.
This Order may be cited as The A550 and A5117 Trunk Roads (Improvement between M56 and A548) and Connecting Roads Order 2006, and shall come into force on 9th June 2006.
2.
In this Order—
(1) all measurements of distance are measured along the route of the relevant highway;
(2)
(i) "the main new road" means the new highway which the Secretary of State proposes to construct along the route described in Schedule 1 to this Order;
(ii) "the new trunk roads" means the main new road and the connecting roads;
(iii) "the plan" means the plan numbered HA 10/MP/041, marked "The A550 and A5117 Trunks Roads (Improvement between M56 and A548) and Connecting Roads Order 2006", signed by authority of the Secretary of State for Transport and deposited at the offices of the Highways Agency, City Tower, Piccadilly Plaza, Piccadilly, Manchester M1 4BE;
(iv) "the connecting roads" means the new highways which the Secretary of State proposes to construct along the routes described in Schedule 2 to this Order and which connect the main new road with other highways or proposed highways at the places stated in that Schedule.
3.
The main new road and the connecting roads shall become trunk roads from the date when this Order comes into force.
4.
The centre line of each of the new trunk roads is indicated by a heavy black line on the plan.
5.
The Secretary of State directs as respects any part of a highway which crosses the route of any of the new trunks roads that—
(a) where the highway is maintainable at the public expense by a local highway authority, the part in question shall be maintained by that authority, and
(b) where the highway is not so maintainable and is not maintainable under a special enactment or by reason of tenure, enclosure or prescription, the Secretary of State shall be under no duty to maintain the part in question,
until, in either case, a date to be specified in a notice given by the Secretary of State to the highway authority for that highway. The date specified will not be later than the date on which the relevant route is opened for traffic.

SCHEDULE 1
ROUTE OF THE NEW MAIN ROAD (A550)
(A)
The route of the new trunk road is about 0.6 kilometres in length, from a point at Deeside Park about 350 metres north of the junction and about 80 metres east of the A550 (Welsh Road) on the England/Wales border in the County of Cheshire, generally northwards to a point on the A550 (Welsh Road) about 85 metres north of the access to the property known as Hill View in the County of Cheshire (this route being given the reference A on the plan).
ROUTE OF THE NEW MAIN ROAD (A5117)
(B)
The route of the new trunk road is about 0.8 kilometres in length, from a point at Deeside Park about 350 metres north of the junction and about 35 metres east of the A550 (Welsh Road) on the England/Wales border in the County of Cheshire, generally northwards to a point on the A5117, 270 metres east of the A5117/A550 Junction at Woodbank in the County of Cheshire (this route being given the reference B on the plan).

The route of the new trunk road is about 1.6 kilometres in length, from a point on the A5117 about 300 metres west of its junction with the A540 in the County of Cheshire, generally eastwards to a point on the A56 Motorway about 250 metres east of Junction 16 Dunkirk Junction in the County of Cheshire (this route being given the reference C on the plan).
SCHEDULE 2
ROUTES OF THE CONNECTING ROADS
1.
A route from the southbound carriageway of the new main road given the reference letter B to a point about 350 metres north of the Deeside Park Junction and about 125 metres east of the A550 (Welsh Road) on the England/Wales border in the County of Cheshire (this route being given the reference number 1 on the plan).
2.
A route from new main road given the reference letter A to the connecting road given the reference number 1 (this route being given the reference number 2 on the plan).
3.
A route to connect the improved A5117 with the new junction, which the Secretary of State proposes to construct at the A540 (Parkgate Road) pursuant to the side roads order (this route being given the reference number 3 on the plan).
4.
A route to connect the new junction at A540 (Parkgate Road) to the A5117, which the Secretary of State proposes to improve pursuant to the side roads order (this route being given the reference number 4 on the plan).
5.
A route to connect the new roundabout junction at A540 (Parkgate Road) to the A5117 to the west which the Secretary of State proposes to improve pursuant to the side roads order (these connecting roads being given the reference number 5 on the plan).
6.
A route to connect the new roundabout junction at A540 (Parkgate Road) to the A5117 to the east which the Secretary of State proposes to improve pursuant to the side roads order (these connecting roads being given the reference number 6 on the plan).
7.
A route from the eastbound carriageway of the new main road given the reference letter C to Junction 16 of the M56 (Dunkirk Junction), which the Secretary of State proposes to improve pursuant to the side roads order (this route being given the reference number 7 on the plan).
