The European Communities (Designation) (No. 2) Order 2006

  Made 7th June 2006 
  Laid before Parliament 8th June 2006 
  Coming into force 29th June 2006 

At the Court at Buckingham Palace, the 7th day of June 2006

Present,

The Queen's Most Excellent Majesty in Council

Her Majesty, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1], is pleased by and with the advice of Her Privy Council, to order as follows:

Citation, commencement and interpretation
     1. —(1) This Order may be cited as the European Communities (Designation) (No. 2) Order 2006 and comes into force on 29th June 2006.

    (2) In this Order—

Designation of Minister or department
    
2. —(1) For the purposes of section 2(2) of the Act, the Minister or government department specified in column (1) of Schedule 1 is designated in relation to the matters specified in column (2) of that Schedule.

    (2) Where—

any of them may make regulations and if regulations are made by more than one, they may do so jointly.

Designation of Northern Ireland Departments
    
3. —(1) For the purposes of section 2(2) of the Act, any Northern Ireland department is designated in relation to the matters specified in Schedule 2.

    (2) Where—

any of them may make regulations and if regulations are made by more than one, they may do so jointly.

    (3) Regulations made by a Northern Ireland department in pursuance of this Order, that are not made jointly with a Minister or government department, form part of the law of Northern Ireland and not of any other part of the United Kingdom.

DESIGNATION OF MINISTERS OR DEPARTMENTS

Matters in relation to which Minister or Department is designated

The Secretary of State Measures relating to the interoperability of electronic road user charging and road tolling systems
The Secretary of State

The Treasury

Rights in respect of State pensions and benefits of members of the pension scheme provided for officials and servants of the Communities
The Secretary of State Measures relating to disclosure requirements in respect of companies, registration and publication of documents and particulars disclosed and languages in which disclosures are authorised or required to be made
The Secretary of State Matters relating to trade in certain goods, including technical assistance, which could be used for capital punishment, torture or other cruel, inhuman or degrading treatment or punishment



SCHEDULE 2
Article 3(1)


MATTERS IN RELATION TO WHICH ANY NORTHERN IRELAND DEPARTMENT IS DESIGNATED


Rights in respect of State pensions and benefits of members of the pension scheme provided for officials and servants of the Communities.



EXPLANATORY NOTE

(This note is not part of the Order)


This Order designates authorities to exercise the power to make regulations conferred by section 2(2) of the European Communities Act 1972. The Order specifies matters for which that power may be exercised.
