The Cattle Identification (Amendment) Regulations 2006

  Laid before Parliament 14th June 2006 
  Coming into force 15th June 2006 

The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on him by that section, makes the following Regulations:

Title and commencement
     1. These Regulations may be cited as the Cattle Identification (Amendment) Regulations 2006 and come into force on 15th June 2006.

Amendments to the Cattle Identification Regulations 1998
    
2. The Cattle Identification Regulations 1998[3] are amended in accordance with these Regulations.

Amendments to regulation 2(1)
     3. —(1) Regulation 2(1) (interpretation) is amended as follows.

    (2) For the definition of "calf passport" substitute—

    (3) For the definition of "cattle passport" substitute—

    (4) For the definition of "the Council Regulation" substitute—

    (5) For the definition of "licensed slaughterhouse" substitute—

    (6) For the definition of "official veterinary surgeon" substitute—

    (7) The definitions of "official veterinarian" and "Regulation 853/2004" (which apply in Scotland) are omitted.

References to Commission Regulation (EC) No. 2629/97
     4. In—

for the words "Commission Regulation (EC) No. 2629/97" substitute "Commission Regulation (EC) No. 911/2004".

References to the Animal By-Products Order 1992
    
5. In regulations 7(5) and 20(4) for the words "the Animal By-Products Order 1992" substitute "the Animal By-Products Regulations 2005[9] in England, the Animal By-Products (Wales) Regulations 2006[10] in Wales, and the Animal By-Products (Scotland) Regulations 2003[11] in Scotland".

Amendments to regulations 20 and 27
     6. In regulations 20 (slaughterhouses and private kills) and 27 (return of cattle passports), in each place that they appear, for the words "licensed slaughterhouse" substitute "slaughterhouse".

Amendment to regulation 31
    
7. In regulation 31 (powers to restrict movements) for "Article 21" substitute "Article 22(1)".

The National Assembly for Wales (Transfer of Functions) Order 1999
    
8. The reference to the Cattle Identification Regulations 1998 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999[12] shall be read as a reference to those Regulations as amended by these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Cattle Identification Regulations 1998 to replace references to Council Regulation (EC) No. 820/97 with references to Council Regulation (EC) No. 1760/2000 and to replace references to Commission Regulation (EC) No. 2629/97 with references to Commission Regulation (EC) No. 911/2004. They also update references to domestic legislation.

A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
