The Secretary of State, being a Minister designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on him by that section, makes the following Regulations:
Title and commencement
1.
These Regulations may be cited as the Cattle Database (Amendment) Regulations 2006 and come into force on 15th June 2006.
Amendments to the Cattle Database Regulations 1998

The Cattle Database Regulations 1998[3] are amended in accordance with these Regulations.
Amendment to regulation 2

—(1) Regulation 2 (interpretation) is amended as follows.
(2) For the definition of "calf passport" substitute—
"
"calf passport" means a document in such form as may be approved by the appropriate Minister in accordance with Article 6.2 of the Commission Regulation for the purpose of moving calves under 28 days old;".
(3) For the definition of "cattle passport" substitute—
"
"cattle passport" means a document containing the information set out in Article 6.1 of the Commission Regulation issued by the appropriate Minister, and includes a calf passport;".
(4) For the definition of "the commission Regulation" substitute—
"
"the Commission Regulation" means Commission Regulation (EC) No. 911/2004 (implementing Regulation (EC) No. 1760/2000 of the European Parliament and of the Council as regards eartags, passports and holding registers[4]);".
(5) For the definition of "the Council Regulation" substitute—
"
"the Council Regulation" means Council Regulation (EC) No. 1760/2000 (establishing a system for the identification and registration of bovine animals and regarding the labelling of beef and beef products and repealing Council Regulation (EC) No. 820/97);".
Amendment to regulation 6

In regulation 6 (notification of birth) omit the words "in accordance with Article 6.3 of the Commission Regulation" and paragraph (a).
Amendment to regulation 8
5.
In regulation 8(1) (notification of death) omit the words "and in accordance with Article 6.3 of the Commission Regulation".
Amendment to regulation 12
6.
In regulation 12 (powers to restrict movements) for "Article 21" substitute "Article 22(1)".
The National Assembly for Wales (Transfer of Functions) Order 2000
7.
The reference to the Cattle Database Regulations 1998 in Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 2000[5] shall be read as a reference to those Regulations as amended by these Regulations.

EXPLANATORY NOTE
(This note is not part of the Regulations)
These Regulations amend the Cattle Database Regulations 1998 to replace references to Council Regulation (EC) No. 820/97 with references to Council Regulation (EC) No. 1760/2000 and replace references to Commission Regulation (EC) No. 2629/97 with references to Commission Regulation (EC) No. 911/2004.
A full regulatory impact assessment has not been produced for this instrument as it has no impact on the costs of business.
