The Secretary of State makes the following Order in exercise of the powers conferred by section 27 of the Further and Higher Education Act 1992[1] ("the Act").
In accordance with section 51 of the Act, he has received a proposal for the dissolution of the further education corporation known as Josiah Mason Sixth Form College, Erdington, Birmingham [2] ("the corporation") from the Learning and Skills Council for England.
In accordance with section 27(7)(a) of the Act he has consulted the corporation. In accordance with section 27(2), the Order is made with the consent of the further education corporation known as Sutton Coldfield College of Further Education [3] ("Sutton Coldfield College").

This Order may be cited as the Josiah Mason Sixth Form College, Erdington, Birmingham (Dissolution) Order 2006 and comes into force on 1st August 2006.

On 1st August 2006 the corporation shall be dissolved and all of its property, rights and liabilities shall be transferred to Sutton Coldfield College, being a body corporate established for purposes which include the provision of educational facilities or services.
3.
Section 26(2), (3) and (4) of the Act shall apply to any person employed by the corporation immediately before 1st August 2006 as if the references in that section—
(a) to a person to whom that section applies were to a person so employed;
(b) to the operative date were to 1st August 2006;
(c) to the transferor were to the corporation; and
(d) to the corporation were to Sutton Coldfield College.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order dissolves with effect from 1st August 2006 the further education corporation established to conduct Josiah Mason Sixth Form College, Erdington, Birmingham. It provides for the transfer of its property, rights and liabilities to Sutton Coldfield College of Further Education and secures the rights of its employees by applying section 26(2) to (4) of the Further and Higher Education Act 1992.
A Regulatory Impact Assessment has not been prepared for this instrument as it has no impact on the costs of business.
