TRANSPORT

The Transport for London (Sloane Square House) Order 2006

  Coming into force 6th September 2006 

The Secretary of State for Transport makes the following Order in exercise of the powers conferred by section 163 of the Greater London Authority Act 1999[1].

Citation and commencement
     1. This Order may be cited as the Transport for London (Sloane Square House) Order 2006 and shall come into force on 6th September 2006.

Consent
     2. The Secretary of State gives consent to Transport for London for the grant of a leasehold interest for a term of more than fifty years in the land described in the Schedule.

EXPLANATORY NOTE

(This note is not part of the Order)


Section 163 of the Greater London Authority Act 1999 prohibits Transport for London from disposing of any freehold interest in operational land or granting a lease for a term of greater than fifty years in respect of such land without the consent of the Secretary of State. Under section 164 of that Act, Transport for London is required to ensure that none of its subsidiaries does anything which Transport for London has no power to do (including anything which Transport for London has no power to do because the consent of the Secretary of State has not been obtained).

The land at Sloane Square House, Sloane Square, London, SW1W 8NS which is the subject of this Order has been operational land as defined in section 163(8) of the Greater London Authority Act 1999. It comprises of part of Sloane Square House which is currently airspace on the first and second floor level, serving as part of a lightwell.

Section 163(3) provides that consent under section 163 is not required in respect of land which was formerly operational land if a period of at least five years has elapsed since the land was last operational land, but such a period has not yet elapsed in this case. Its disposal therefore requires the consent of the Secretary of State. The land is currently vested in London Underground Limited, a subsidiary of Transport for London, and the disposal of the land will be made by that company.

By this Order the Secretary of State for Transport gives consent to Transport for London for the disposal of the land which is the subject of the Order.

A full regulatory impact assessment has not been produced for this Order as it has no impact on the costs of business, charities or voluntary bodies.
