The Secretary of State for Transport makes this Order in exercise of powers conferred by section 10 and 12 of the Highways Act 1980[1] and now vested in him[2]:-
1.
This Order may be cited as the Al Trunk Road (A57, A638 and B1164 Junction Improvement Markham Moor) (Detrunking) Order 2006 and shall come into force on 3 November 2006

In this Order
(a) "classified road" as a classification for a highway, means that the highway is not a principal road for the purposes of enactments or instruments which refer to highways classified as principal roads but is a classified road for the purpose of every enactment and instrument which refers to highways classified by the Secretary of State and which does not specifically refer to their classification as principal roads;
(b) "the plan" means the plan folio consisting of the key plan and the site plan, numbered "HA 10/MP/081" and titled "A1 Trunk Road (A57, A638 and B1164 Junction Improvement Markham Moor) (Detrunking) Order 2006" signed by authority of the Secretary of State for Transport, DfT Records Management Branch, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA.
(c) "the new trunk road" means the new highways which the Secretary of State proposes to construct referred to in article 2 of the Al Trunk Road (A57, A638 and B1164 Junction Improvement Markham Moor) Order 2006[3]; and
(d) "the trunk road" means the London to Edinburgh Trunk Road (A1).

The length of the trunk road described in the Schedule to this Order shall cease to be a trunk road and shall be classified as a classified road from the date on which the Secretary of State notifies Nottinghamshire County Council that the new trunk roads are open for traffic.

THE SCHEDULE
LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD
The lengths of trunk road ceasing to be trunk road are situated as follows:
Over part width of highway, between a point approximately 161 metres south-east of the south-west corner of McDonalds Restaurant, including the north-east part of Markham Moor roundabout, and a point approximately 162 metres west of the same corner of that same building and shown by broad black dashes on the plan folio numbered HA10/MP/081.
Over part width of highway, between a point approximately 185 metres south-east of the south-west corner of McDonalds Restaurant and a point approximately 216 metres west of the same corner of that same building and shown by broad black dashes on the plan folio numbered HA10/MP/081.
