The Council of the Borough of Blackburn with Darwen acting in its capacity as a local education authority ("the authority") has, in accordance with section 4(2) of the Education Act 2002[1] ("the Act"), consulted such persons as appear to them to be appropriate;
It is the opinion of the Secretary of State, having regard to the matters set out in section 1(2) of the Act, that the extension of the period for which the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004[2] has effect and the other provisions contained in this Order, may contribute to the raising of educational standards achieved by children in England;
In exercise of the powers conferred upon the Secretary of State by sections 2(1) and 3(1)[3] of the Act, the Secretary of State for Education and Skills, on the application of the authority, makes the following Order:
Citation and commencement
1.
This Order may be cited as the Blackburn with Darwen (Maintained Nursery School Governance) (Amendment) Order 2007 and comes into force on 30th March 2007.
Amendment
2.
Article 3 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004 is amended as follows:
(a) for Article 3(b) substitute:
"
(b) sections 7(b) and 13(2) of the Education Act 2005 as if after the words "in the case of a maintained school" the words "other than a maintained nursery school" were added."
(b) after Article 3(d) insert a new sub-paragraph:
"
(dd) On and after the date section 88 of the Education and Inspections Act 2006 comes into force, section 88(5) of that Act (responsibility of governing body for discipline) as if paragraph (c) of that subsection were omitted."
(c) omit Article 3(l) and (m).

In Article 5 of the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004, for "30th March 2007" substitute "30th March 2009".

EXPLANATORY NOTE
(This note is not part of the Order)
This Order is made under sections 2 and 3 of the Education Act 2002, to amend the Blackburn with Darwen (Maintained Nursery School Governance) Order 2004. Article 2 extends the period for which the Council of Borough of Blackburn with Darwen is exempt from the requirement in Part 3 of that Act to constitute a governing body for seven of its nine maintained nursery schools, for a further two years.
