" Prescribed time for objections to or representations on proposals"



(b) after the words "section 3(1)", in the first place where they occur, there shall be inserted the words "and section 7"; and

(c) after the words "section 3(1)", in the second place where they occur, there shall be inserted the words "or, as the case may be, section 7".



Passing to Commissioners of objections or representations
     3. For Rule 9 there shall be substituted the following Rule—



" Passing to Commissioners of objections or representations"




     9. Where objections or representations are received by the Board in response to a notice given under sections 3(1) or 7 of the Measure, the Board shall within five working days of receipt send such objections or representations to the Commissioners for consideration.".



Citation, commencement and interpretation
     4. —(1) These Rules may be cited as the Parsonages Measure (Amendment) Rules 2007 and shall come into force on 1st May 2007.

    (2) Any reference in these Rules to a Rule or the Schedule is a reference to a Rule of or, as the case may be, to the Schedule to the Parsonages Measure Rules 2000[6].

EXPLANATORY NOTE

(This note is not part of the Rules)

These Rules amend the Parsonages Measure Rules 2000 (S.I. 2000/3171) and take account of amendments to the Parsonages Measure 1938 made by the Church of England (Miscellaneous Provisions) Measure 2006. The amendments relate to Rules 7, 8 and 9 of the 2000 Rules and the Schedule. The form of the notices required to be served under sections 3 and 7 of the 1938 Measure of the exercise of certain powers under the Measure is no longer prescribed but, instead, the notices require objections or representations to be made within the prescribed time of 21 days and they must be passed to the Church Commissioners within 5 working days.
