The Lord Chief Justice, in exercise of the powers conferred on him by section 19 of the Courts Act 2003[1], and after having consulted the Lord Chancellor, the Criminal Procedure Rule Committee, the Family Procedure Rule Committee and the Magistrates' Courts Rule Committee, as required by section 20(2) of the Courts Act 2003, makes the following Rules:
Citation and commencement

These Rules may be cited as the Justices of the Peace (Training and Appraisal) (Amendment) Rules 2007 and come into force on 1st May 2007.
Interpretation
2.
In these Rules a reference to the ‘2005 Rules' is a reference to the Justices of the Peace (Training and Appraisal) Rules 2005[2] and a reference to a rule by number alone is a reference to the rule so numbered in the 2005 Rules.
Amendments to the 2005 Rules

The 2005 Rules are amended as follows.

—(1) Rule 2 is amended as follows.
(2) In the definition "an MATC", after "these Rules" insert "and for the avoidance of doubt includes a combined MATC".
(3) In the appropriate place insert—
"
"MATC area" means an area of England and Wales for which there is an MATC established in accordance with rule 16.".

In rule 10(2) for "Courts Board" substitute "MATC".

—(1) Rule 16 is amended as follows.
(2) For paragraph (1) substitute—
"
(1) Subject to paragraphs (3) and (4) there shall be an MATC for each courts board area in existence on 1st January 2006.".
(3) In paragraph (3)(a) for "courts board" substitute "MATC".
(4) In paragraph (4)—
(a) at the beginning, for "The" substitute "Two or more";
(b) after "MATCs" delete the words "for two or more courts board areas".

—(1) Rule 17 is amended as follows.
(2) In paragraphs (1), (1)(b), (1)(c) and (5)(a) for "courts board" substitute "MATC".
(3) In paragraph (6) for the words after "assigned within" substitute "the MATC area, the Area Director, or Area Directors, in whose area, or areas, the MATC lies shall appoint one of the justices' clerks to the MATC".
(4) In paragraph (8)—
(a) at the beginning, for "The" substitute "Any";
(b) after "Area Director" insert "in whose area an MATC lies".

—(1) Rule 18 is amended as follows.
(2) In paragraph (1)—
(a) for "courts board" substitute "MATC";
(b) for “("the MATC area")“ substitute “("the combined area")“.
(3) In paragraph (1)(b)—
(a) after "assigned" insert "to a local justice area";
(b) for the words from "each of" to the end substitute "the combined area".
(4) In paragraph (1)(c) and (5)(a) for "MATC" substitute "combined".
(5) Delete paragraph (6) and substitute with—
"
(6) If there is more than one justices' clerk assigned within the combined area, the Area Director, or Area Directors, in whose area, or areas the combined MATC lies shall appoint one of the justices' clerks to the combined MATC.
(7) Any Area Director in whose area a combined MATC lies may attend the meetings of the combined MATC in an advisory capacity only.".

EXPLANATORY NOTE
(This note is not part of the Rules)
These Rules amend the Justices of the Peace (Training and Appraisal) Rules 2005 ("the 2005 Rules") (S.I. 2005/564). The 2005 Rules established Magistrate Area Training Committees ("MATCs") which consider the training needs of magistrates. The 2005 Rules link the establishment and operation of MATCs to courts boards areas, the boundaries of which are described in the Schedule to the Courts Boards Areas Order 2004 (S.I. 2004/1192). The boundaries of the courts boards areas will be changed by S.I. 2007/1022, which comes into force on the same day as these Rules. These Rules ensure that, notwithstanding the changes to courts boards areas, the operation of the existing MATCs will be unaffected.
