The Bluetongue (Compensation) Order 2007

  Made 17th October 2007 
  Laid before Parliament 19th October 2007 
  Coming into force 20th October 2007 

With the approval of the Treasury, the Secretary of State makes the following Order in exercise of the powers conferred by section 32(3) of the Animal Health Act 1981[1] and now vested in him[2].

Citation, commencement and application
     1. This Order—

Compensation
    
2. —(1) Paragraph (2) applies where the Secretary of State causes any animal to be slaughtered under section 32 of the Animal Health Act 1981 as applied to bluetongue by article 13 of the Bluetongue Order 2003[3].

    (2) The compensation payable by the Secretary of State in respect of the animal shall be its market value immediately before it was slaughtered had it not been affected or suspected of being affected with, or had it not been exposed to the infection of, bluetongue.

    (3) In this article, "animal" means a ruminating animal.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order makes provision for compensation to be paid in respect of an animal affected with, suspected of being affected with, or exposed to the infection of, bluetongue slaughtered under section 32 of the Animal Health Act 1981 (c. 22). The amount of compensation is the market value of the animal immediately before it is slaughtered, had it not been so affected, suspected of being affected or exposed to infection.

An impact assessment has not been prepared for these Regulations as no impact on the private or voluntary sectors is foreseen.

[2] Functions conferred under the 1981 Act on "the Minister" and "the Ministers" are now exercisable by the Secretary of State. Functions of "the Ministers" were transferred, so far as exercisable by the Secretaries of State for Scotland and Wales, to the Minister of Agriculture, Fisheries and Food by the Transfer of Functions (Agriculture and Food) Order 1999 (S.I. 1999/3141). Functions of the Minister of Agriculture, Fisheries and Food were then further transferred to the Secretary of State by the Ministry of Agriculture, Fisheries and Food (Dissolution) Order 2002 (S.I. 2002/794).back
