The Ozone Depleting Substances (Qualifications) (Amendment) Regulations 2008

The Secretary of State is a Minister designated(1) for the purposes of section 2(2) of the European Communities Act 1972(2) in relation to measures relating to the protection of the ozone layer and measures relating to substances that deplete the ozone layer.

He makes these Regulations in exercise of the powers conferred by that section.

Citation and commencement

1. These Regulations–

(a) may be cited as the Ozone Depleting Substances (Qualifications) (Amendment) Regulations 2008; and

(b) come into force on 15th February 2008.

Amendment

2.–(1) The Ozone Depleting Substances (Qualifications) Regulations 2006(3), are amended in accordance with paragraphs (2) and (3).

(2) In regulation 3, for paragraph (a) substitute–

"(a) a person is competent to carry out relevant work whilst performing a task specified in column 1 of the Table in Schedule 1 in respect of the equipment specified in the corresponding entry in column 2 of that Table if that person has obtained one of the qualifications specified in the corresponding entry in column 3 of that Table;".

(3) In column 3 of Schedule 1 for "British Fire Protection Systems Association Competence Certificate Course Class I." substitute–

"(a) British Fire Protection Systems Association Competence Certificate Course Class I.

(b) Fire Industry Competence Certificate Course Class 1." (4).

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the minimum qualifications in Schedule 1 to the Ozone Depleting Substances (Qualifications) Regulations 2006, S.I. 2006/1510, in relation to the decommissioning of fire protection systems and fire extinguishers.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.

The power of the Secretary of State, as a Minister designated in relation to measures relating to the protection of the ozone layer and measures relating to substances that deplete the ozone layer, to make regulations which extend to Scotland remains exercisable by virtue of section 57(1) of the Scotland Act 1998 (c. 46).
