The Countryside and Rights of Way Act 2000 (Commencement No. 15) Order 2008

In exercise of the powers conferred by section 103(3) of the Countryside and Rights of Way Act 2000(1), the Secretary of State makes the following Order.

Citation and application

1. This Order–

(a) may be cited as the Countryside and Rights of Way Act 2000 (Commencement No. 15) Order 2008; and

(b) applies in relation to England only.

Appointed day

2. 18th February 2008 is the day appointed for the coming into force of the following provisions of the Countryside and Rights of Way Act 2000–

(a) section 51 (which gives effect to Schedule 5) in so far as it gives effect to the provision referred to in sub-paragraph (b); and

(b) paragraph 2 of Part 1 of Schedule 5, to the extent that it inserts section 53A into the Wildlife and Countryside Act 1981(2).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force on 18th February 2008, in relation to England, that part of paragraph 2 of Schedule 5 to the Countryside and Rights of Way Act 2000 (c. 37) which inserts a section 53A into the Wildlife and Countryside Act 1981 (c. 69) ("the 1981 Act").

Section 53A of the 1981 Act will permit any Order of a specified kind (Orders which provide for making changes in respect of certain types of highway) now also to provide for the required consequential modification of the definitive maps and statements which record such highways. The Orders must be of a kind described in section 53A(1)(b) to (d) and of a description prescribed in regulations made under section 53A(1)(a). Without the insertion, and subsequent application, of section 53A of the 1981 Act, the required modifications to the definitive maps and statements can only be effected by means of a separate modification Order under section 53(2)(b) of the 1981 Act.
