The Secretary of State for Children, Schools and Families makes the following Regulations in exercise of the powers conferred by sections 537, 537A and 569(4) of the Education Act 1996(1).
1.–(1) These Regulations may be cited as the Education (School Performance Information) (England) (Amendment) Regulations 2008 and come into force on 1st April 2008.
(2) These Regulations apply only in relation to England.
2.–(1) The Education (School Performance Information) (England) Regulations 2007(2) are amended as follows.
(2) In paragraph 2(2)(f) of Schedule 3, after "administered" insert "and (if so) the reason for the absence".

These regulations amend the Education (School Performance Information) (England) Regulations 2007 so as to provide for schools to supply to the Secretary of State, on receipt of a written request, the reason for the absence of a pupil from a Key Stage 3 National Curriculum test.
1996 c.56. Section 537A was inserted by section 20 of the Education Act 1997 (c. 44) and then substituted by paragraph 153 of Schedule 30 to the School Standards and Framework Act 1998 (c. 31). For the meaning of "prescribed" and "regulations", see section 579(1) of the Education Act 1996. Back [1]
