The Secretary of State for Work and Pensions, in exercise of the powers conferred by sections 70(2) of the Welfare Reform Act 2007(1), makes the following Order:
1.–(1) This Order may be cited as the Welfare Reform Act 2007 (Commencement No. 5) Order 2008.
(2) In this Order "the Act" means the Welfare Reform Act 2007.
2.–(1) For the purpose only of conferring power to make regulations 1st April 2008 is the appointed day for the coming into force of–
(a) section 32 of the Act (housing benefit and council tax benefit for persons taking up employment);
(b) section 33 of the Act (section 32: supplemental); and
(c) section 34 of the Act (sections 32 and 33: interpretation).
(2) For all other purposes 6th October 2008 is the appointed day for the coming into force of the provisions specified in paragraph (1).
(3) 1st April 2008 is the appointed day for the coming into force of–
(a) section 38 of the Act (duty to send inspection reports to the Secretary of State);
(b) section 39 of the Act (directions by the Secretary of State); and
(c) paragraphs 5 to 7 and 9 of Schedule 5 to the Act (minor and consequential amendments relating to Part 2) in so far as they relate to the amendment of sections 139E, 139F, 139G and 140B(5A) of the Social Security Administration Act 1992 and section 40 of the Act in so far as it relates those amendments.
(4) For the purpose only of conferring power to make regulations 19th February 2008 is the appointed day for the coming into force of–
(a) section 46 of the Act (local authority powers to investigate fraud); and
(b) section 47 of the Act (local authority powers to prosecute benefit fraud).
(5) For all other purposes 7th April 2008 is the appointed day for the coming into force of the provisions specified in paragraph (4).

This Order brings into force the following provisions in the Welfare Reform Act 2007 ("the Act")–

A full impact assessment has not been published for this instrument as it has no impact on the costs of businesses, charities and the voluntary sector.
