The A456 Trunk Road (Detrunking) Order 2008

The Secretary of State for Transport makes this Order in exercise of powers conferred by sections 10 and 12 of the Highways Act 1980(1) and now vested in her(2).

1. This Order may be cited as the A456 Trunk Road (Detrunking) Order 2008 and shall come into force on 28th April 2008.

2. In this Order–

(i) "the plan" means the plan folio numbered HA10/TD/020 consisting of sheets 1 and 2 and marked "A456 (Detrunking) Order 2008". signed by the authority of the Secretary of State for Transport and deposited at DETR Records Management Branch, Ashdown House, 123 Victoria Street, London SW1 6DE;

(ii) "principal road" as a classification for a highway, means that the highway is a principal road for the purposes of enactments and instruments which refer to highways classified as principal roads and is also classified for the purpose of every other enactment and instrument which refers to highways classified by the Secretary of State; and

(iii) "the trunk road" means the A456 Trunk Road.

3. The length of the trunk road described in the Schedule shall cease to be a trunk road and shall be classified as a principal road from the date on which this Order comes into force.

THE SCHEDULE LENGTH OF THE TRUNK ROAD CEASING TO BE A TRUNK ROAD

1. The length of the trunk road ceasing to be a trunk road is situated between a point 5m east of the centre of the A449/A456 junction in Kidderminster to a point 112m west of the centre of the A456/M5 junction 3, coincident with the intersection of the A456 and the circulatory carriageway of the roundabout and is shown by broad black dashes on the plan numbered HA10/TD/020, marked "The A456 Trunk Road (Worcestershire and Dudley) (Detrunking) Order 2008", signed by the authority of the Secretary of State for Transport, DETR Records Management Branch, Ashdown House, 123 Victoria Street, London SW1 6DE.

Explanatory Note

(This note is not part of the Order)

This Order reclassifies the length of the road situated between a point 5m east of the centre of the A449/A456 junction in Kidderminster to a point 112m west of the centre of the A456/M5 junction 3, coincident with the intersection of the A456 and the circulatory carriageway of the roundabout, so that it is no longer a trunk road, but becomes a principal road.

THE A456 TRUNK ROAD (DETRUNKING) ORDER 2008

THE SECRETARY OF STATE FOR TRANSPORT hereby gives notice that she proposes to make the following Order:-

1. An Order under sections 10 and 12 of the Highways Act 1980 which will provide that a length of the A456 Trunk Road starting from a point 5m east of the centre of the A449/A456 junction in Kidderminster to a point 112m west of the centre of the A456/M5 junction 3, (this point is coincident with the intersection of the A456 and the circulatory carriageway of the roundabout) shall cease to be trunk road and shall be classified as a principal road, from the date on which the Order comes into force.

COPIES of the Order and the plans referred to in them may be inspected free of charge at all reasonable hours from 14th March 2008 or within 6 weeks from the date of first publication of this notice if that period expires later, at the Highways Agency Reception, Traffic Operations Directorate, C4 Broadway, Broad Street, Birmingham B151BL; Worcestershire County Council, County Hall; Dudley MBC, Council House, Dudley; Dudley Reference Library, St James Rd, Dudley; Worcester Library, Foregate Street, Worcester.

ANY PERSON MAY OBJECT to the making of this Order no later than 28th April 2008, or within 6 weeks from the date of first publication of this notice if that expires later, by notice to the Secretary of State at the offices of the Highways Agency, Project Services Division, Room C4, Broadway, Broad Street, Birmingham B15 1BL quoting reference HA HA/O65/030/000160 and stating the grounds of objection. In the preparation of an objection and the statement of grounds of objection it should be borne in mind that the substance of any objection or representation may be communicated to other people who may be affected by it.
