The Secretary of State for Health makes the following Regulations, in exercise of the powers conferred by section 2 of the Abortion Act 1967(1).
1.–(1) These Regulations may be cited as the Abortion (Amendment) Regulations 2008 and shall come into force on the 21st April 2008.
(2) These Regulations apply in relation to England only.
2. In regulation 5 of the Abortion Regulations 1991(2), for sub-paragraph (ii) of paragraph (a) substitute–
"(ii) to the National Statistician duly appointed under section 5 of the Statistics and Registration Service Act 2007(3) or an employee of the Statistics Board (established under section 1 of that Act) authorised by the National Statistician".

These Regulations amend regulation 5 of the Abortion Regulations 1991 by substituting regulation 5(a)(ii), in order to reflect the changes made by the Statistics and Registration Service Act 2007 which establishes an independent Statistics Board under section 1, which is responsible for the statistical functions previously carried out by the Registrar General through its administrative arm, the Office of National Statistics. That Act also makes provision under section 5 for the appointment of the National Statistician.
A full impact assessment has not been produced for this instrument as it has no impact on the costs of business.
1967 c. 87; section 2(2) was amended by the Transfer of Functions (Wales) Order 1969 (S.I.1969/388), article 2(2) and Schedule 1, and by the Transfer of Functions (Health and Social Security) Order 1988 (S.I. 1988/1843), article 5(4) and Schedule 3, and by the Scotland Act 1998 (Consequential Modifications) (No.1) Order 1999 (S.I.1999/1042) article 5 and Schedule 3. As regards Wales, the functions of the Secretary of State under section 2 of the Act are transferred to the National Assembly for Wales under article 2 of, and Schedule 1 to the National Assembly for Wales (Transfer of Functions) Order 1999, S.I. 1999/672. As regards Scotland, the functions of the Secretary of State under section 2 of the Act are transferred, in so far as they are exercisable in or regards Scotland, to the Scottish Ministers, under article 2 of, and Schedule 1 to the Scotland Act 1998 (Transfer of Functions to the Scottish Ministers etc.) Order 1999, S.I. 1999/1750.
