The Child Maintenance and Other Payments Act 2008 (Commencement No.2) Order 2008

The Secretary of State, in exercise of the powers conferred by section 62(3) of the Child Maintenance and Other Payments Act 2008(1), makes the following Order:

Citation and interpretation

1.–(1) This Order may be cited as the Child Maintenance and Other Payments Act 2008 (Commencement No.2) Order 2008.

(2) In this Order any reference to a numbered section, part or schedule is a reference to a section or part of, or schedule to, the Child Maintenance and Other Payments Act 2008.

Appointed days

2.–(1) 24th July 2008 is the day appointed for the coming into force of Part 1 and Schedule 1 (which are the provisions establishing the Child Maintenance and Enforcement Commission), in so far as those provisions are not already in force, except section 3(1)(a) (Commission to have the functions relating to child support transferred from the Secretary of State).

(2) 5th August is the day appointed for the coming into force of section 43 (extinction of liability in respect of interest and fees).

EXPLANATORY NOTE

(This note is not part of the Order)

This Order brings into force provisions of the Child Maintenance and Other Payments Act 2008 as follows:

Article 2 brings fully into force on 24th July the provisions in Part 1 and Schedule 1 establishing the Child Maintenance and Enforcement Commission, apart from provisions conferring functions relating to child support transferred from the Secretary of State. The provision in section 43 extinguishing fees and penalties is brought into force on 5th August 2008.
