Coming into force in accordance with article 1

The Secretary of State for Transport makes this Instrument in exercise of powers conferred by section 106(3) of the Highways Act 1980 (1)and now vested in him(2).

1. This Instrument may be cited as "The Council of the City of Wakefield (Wakefield Waterfront Hepworth Gallery Footbridge) Scheme 2008 Confirmation Instrument 2008" and shall come into force on the date on which notice that it has been confirmed is first published in accordance with paragraph 1 of Schedule 2 to the Highways Act 1980.

2. The Council of the City of Wakefield (Wakefield Waterfront Hepworth Gallery Footbridge) Scheme 2008 ("the Scheme") is hereby confirmed with modifications.

3. The Scheme as confirmed is set out in the Schedule hereto (including the plans) and copies of the Scheme with its accompanying plans as modified are deposited at the offices of the Department for Transport, Floor 13 (IMD), Ashdown House, St Leonards on Sea, Hastings, East Sussex TN37 7GA, and at the offices of the Council of the City of Wakefield, Reception Desk, County Hall, Wakefield WF1 2QW.

THE SCHEDULE

The Council of the City of Wakefield (hereinafter referred to as "the Council" makes this Scheme in exercise of their powers under section 106(3) of the Highways Act 1980 and all other powers enabling them in that behalf.

1. The Council are authorised to construct over the navigable waters of the River Calder the footbridge specified in the Schedule to this Scheme as part of the highway which is to be constructed between Thornes Lane and the Hepworth Gallery in the Metropolitan District of Wakefield.

2. The Scheme may be cited as the Council of the City of Wakefield (Wakefield Waterfront Hepworth Gallery Footbridge) Scheme 2008.

- THE SCHEDULE TO THE SCHEME

PLANS AND SPECIFICATIONS OF THE FOOTBRIDGE

The location and general design of the Footbridge are shown on the plan numbered DWG No. 3346 and marked "The Council of the City Wakefield (Wakefield Waterfront Hepworth Gallery Footbridge) Scheme 2008".

POINTS OF COMMENCEMENT AND TERMINATION

THORNES LANE APPROACH_FROM THRESHOLD

From a point along the northern bank of the River Calder (on Thornes Lane) 106.15 metres west of the top north western parapet of the New Wakefield Bridge and 62.9 metres south. (126.5 metres measured in a direct line, point to point.)

HEPWORTH GALLERY APPROACH_FROM THRESHOLD

To a point on the south bank of the River Calder, 98.55 metres south of the top north western parapet of the New Wakefield Bridge and 69.89 metres west. (122.12 metres measured in a direct line, point to point.)

SPAN

The footbridge is 50.8 metres long, with a single clear span of 43.6 metres.

HEADWAY

Not less than 3.66 metres above normal water level of 22.11 metres A.O.D. over the whole waterway.

WATERWAY

The entire navigable width of the waterway is maintained.

Explanatory Note

(This note is not part of the Instrument)

This instrument confirms a scheme to construct over the navigable waters of the River Calder a footbridge as part of the highway which is to be constructed between Thornes Lane and the Hepworth Gallery in the Metropolitan District of Wakefield.
