Coming into force in accordance with article 2
The Lord Chancellor makes the following Order in exercise of the powers conferred by paragraph 25(2) of Schedule 7 to the Tribunals, Courts and Enforcement Act 2007(1).
1. This Order may be cited as the Administrative Justice and Tribunals Council (Listed Tribunals) (Amendment) Order 2009.
2.–(1) Subject to paragraph (2), this Order comes into force on 8th December 2009.
(2) Article 3(b) comes into force on 25th January 2010.
3. In the table in article 2 of the Administrative Justice and Tribunals Council (Listed Tribunals) Order 2007(2) (list of tribunals)–
(a) for the entry relating to the Valuation Tribunals in England substitute–
"Valuation Tribunal for England | Paragraph A1 of Schedule 11 to the Local Government Finance Act 1988 (c. 41)(3)"; |
(b) after the entry relating to the National Lottery Commission insert–
"Office of the Health Professions Adjudicator, except for its functions in respect of Northern Ireland | section 98 of the Health and Social Care Act 2008 (c. 14)". |

This Order is made under the Tribunals, Courts and Enforcement Act 2007. That Act established the Administrative Justice and Tribunals Council (AJTC) to replace the Council on Tribunals and to keep under review, consider and report on matters relating to listed tribunals. On the coming into force of the 2007 Act the only listed tribunals were the two new tribunals provided for in the 2007 Act, being the First-tier Tribunal and the Upper Tribunal. However, the Administrative Justice and Tribunals Council (Listed Tribunals) Order 2007 designated additional entities as listed tribunals.
This Order amends the 2007 Order, removing the entry in that Order for Valuation Tribunals for England and replacing it with an entry relating to the Valuation Tribunal for England, and adding an entry relating to the Office of the Health Professions Adjudicator (except in respect of its functions in Northern Ireland).
