The Water Resources (Control of Pollution) (Silage, Slurry and Agricultural Fuel Oil) (England) (Amendment) Regulations 2010

The Secretary of State makes the following Regulations in exercise of the powers conferred by sections 92 and 219(2)(d) to (f) of the Water Resources Act 1991(1).

Citation, commencement and application

1. These Regulations–

(a) may be cited as the Water Resources (Control of Pollution) (Silage, Slurry and Agricultural Fuel Oil) (England) (Amendment) Regulations 2010;

(b) apply to England only; and

(c) come into force on 6th April 2010.

Amendments to the Water Resources (Control of Pollution) (Silage, Slurry and Agricultural Fuel Oil) (England) Regulations 2010

2. The Water Resources (Control of Pollution) (Silage, Slurry and Agricultural Fuel Oil) (England) Regulations 2010(2) are amended in accordance with regulations 3 to 6.

Regulation 2 (Interpretation)

3. In regulation 2, in the definition of "silage effluent" omit the words "or a crop being made into silage".

Regulation 3 (Making or storage of silage)

4. In regulation 3–

(a) in paragraph (1), omit the words "subject to paragraph (4),"; and

(b) for paragraph (4), substitute–

"(4) A person who has custody or control of a silage bale must not open or remove the wrapping of the bale within 10 metres of any inland freshwaters or coastal waters which silage effluent could enter as a result.".

Regulation 7 (Notice requiring works etc.)

5. After regulation 7(4) insert–

"(4A) A person on whom a regulation 7 notice has been served must comply with the requirements of that notice.".

Regulation 10 (Offences and penalties)

6. In regulation 10(1) for "7(1)" substitute "7(4A)".

EXPLANATORY NOTE

(This note is not part of the Regulations)

The Regulations amend the Water Resources (Control of Pollution) (Silage, Slurry and Agricultural Fuel Oil (England) Regulations 2010 (S.I. 2010/639), and correct a number of defects including clarifying the offence provisions in those Regulations. These Regulations are being issued free of charge to all known recipients of those Regulations.

A full impact assessment has not been produced for this instrument as no impact on the private and voluntary sectors is foreseen.
