The Secretary of State for Transport makes the following Regulations in exercise of the powers conferred by section 41(1), (2) and (5) of the Road Traffic Act 1988(1), having, in accordance with section 195(2) of that Act, consulted with such representative organisations as he thinks fit.

Citation and commencement

1. These Regulations may be cited as the Road Vehicles (Construction and Use) (Amendment) (No. 3) Regulations 2010 and come into force on 9th September 2010.

Amendment of Regulations

2.-(1) The Road Vehicles (Construction and Use) Regulations 1986(2) are amended as follows.

(2) In the Table in regulation 3(2) (interpretation), for the meaning specified in column 2 for the expression "the Community Recording Equipment Regulation"(3) substitute -

"Council Regulation (EEC) No. 3821/85 on recording equipment in road transport(4) as read with the Community Drivers" Hours and Recording Equipment Regulations 2007(5).".

(3) In paragraph 7 of Part I of Schedule 7B (emissions from certain motor vehicles), for sub-paragraph (b)(6) substitute-

"(b)"the emissions publication" is the publication entitled "In Service Exhaust Emission Standards for Road Vehicles - Sixteenth Edition" (ISBN 978-0-9549352-6-9) published by the Department for Transport.".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations further amend the Road Vehicles (Construction and Use) Regulations 1986 ("the 1986 Regulations").

Regulation 2(2) amends the definition of "the Community Recording Equipment Regulation" in regulation 3 of the 1986 Regulations to take into account amendments made to Council Regulation (EEC) No. 3821/85.

Regulation 2(3) amends the definition of "the emissions publication" in Schedule 7B to the 1986 Regulations so as to refer to the most recent edition of the publication, entitled "In Service Exhaust Emission Standards for Road Vehicles-Sixteenth Edition" (ISBN 978-0-9549352-6-9). The publication contains in-use emissions limits that petrol-engined cars and light vans are required to meet at MoT and roadside emissions tests. The publication updates information on new models of petrol-engined passenger cars and light commercial vehicles which have come onto the market since the previous amending Regulations (S.I. 2009/1806) came into force on 1st August 2009; it also revises a small amount of data on existing models.

An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen. The Explanatory Memorandum is available alongside this instrument on the OPSI website ().
