The Secretary of State for Education makes the following Regulations in exercise of the powers conferred by section 63 of the School Standards and Framework Act 1998(1).
1. These Regulations may be cited as the Education (School Attendance Targets) (England) (Amendment) Regulations 2010 and come into force on 23rd December 2010.
2.-(1) The Education (School Attendance Targets) (England) Regulations 2007(2) are amended as follows.
(2) Regulations 3 and 4 (duty on schools to set targets to reduce absence) are omitted.
(3) In regulation 10 (agreement and notification of targets)-
(a)in paragraph (1), omit "4 or"; and
(b)in paragraph (3), for "each of the dates in regulations 4(1) and 9(1) above" substitute "the date in regulation 9(1)(c)".
(4) In regulation 11 (notification of targets), omit "4,".

These Regulations amend the Education (School Attendance Targets) (England) Regulations 2007 ("the Principal Regulations").
Regulation 2(2) revokes the requirements on governing bodies in regulations 3 and 4 of the Principal Regulations to set annual targets for reducing the number of absences and to notify the local authority of those targets.
Regulations 2(3) and (4) make amendments to regulations 10 and 11 of the Principal Regulations which are consequential on the omission of regulations 3 and 4 so that the local authority no longer has to arrange for revised targets to be set or give the Secretary of State information about such targets.
No impact assessment has been produced for this instrument because no impact on the private, voluntary or public sector is foreseen.
