The Secretary of State for Work and Pensions makes the following Order in exercise of the powers conferred by section 149(1) of the Pensions Act 2008(1).
1. This Order may be cited as the Pensions Act 2008 (Commencement No. 10) Order 2011.
2. The following provisions of the Pensions Act 2008 shall come into force on 6th April 2012-
(a)section 106 (contracting-out: abolition of all protected rights),
(b)section 148 (repeals), in so far as it relates to Part 3 of Schedule 11, and
(c)Part 3 of Schedule 11 (repeals having effect in accordance with section 106).

This Order brings into force section 106 of the Pensions Act 2008 (c.30), and related repeals, which provide for the removal of special provisions which apply to the protected rights of members of pension schemes on the contracting-out abolition date (defined in section 106(4) of that Act as the day appointed under section 30 of the Pensions Act 2007 (c.22) for the coming into force of section 15(1) of the Pensions Act 2007). The Pensions Act 2007 (Commencement No. 4) Order 2011 [S.I. 2011/1267 (C. 51)] specifies 6th April 2012 as the day for the coming into force of section 15(1) of the Pensions Act 2007.
This instrument has no impact on the private sector and civil society organisations. However, related legislation reduces costs on the private sector and civil society organisations, and an assessment of the overall impact of the policy has been made. A copy of the impact assessment is available in the libraries of both Houses of Parliament, and is annexed to the Explanatory Memorandum for the Pensions Act 2008 (Abolition of Protected Rights) (Consequential Amendments) Order 2011 (S.I. 2011/1246) which is available alongside that instrument on www.legislation.gov.uk.
