The Secretary of State is a Minister designated for the purposes of section 2(2) of the European Communities Act 1972(1) in relation to the European Parliament including elections to the Parliament and members of the Parliament(2).
The Secretary of State makes the following Order in exercise of the powers conferred by section 2(2) of that Act.
1. This Order may be cited as the Members of the European Parliament (Salaries of Members of the Greater London Authority) Order 2011 and comes into force on 31st January 2012.
2.-(1) Omit the word "or" at the end of section 25(1)(b) of the Greater London Authority Act 1999(3); and
(2) after that paragraph insert-
"(ba) under Article 9 of the Statute for Members of the European Parliament (European Parliament Decision 2005/684/EC, Euratom)(4) (entitlement to salary for MEPs); or".

This Order amends section 25 of the Greater London Authority Act 1999 ("the 1999 Act") to add to the reference to the payment of salary to United Kingdom MEPs under section 1 of the European Parliament (Pay and Pensions) Act 1979 (c.50), a reference to the payment of salary to United Kingdom MEPs under Article 9 of the Statute for Members of the European Parliament.
With effect from 14 July 2009 all new Members of the European Parliament are paid directly by the European Parliament. The effect of this Order is that a further amending order can be made under section 25 of the 1999 Act to preserve the current position that any member of the GLA only receives a third of a full GLA member salary if they are also an MEP.
An impact assessment has not been produced for this instrument as no impact on the private or voluntary sectors is foreseen.
